Irvings client compensated for accident in Spain
Mr W was on holiday in Spain with a friend. Whilst driving them to their villa the friend misjudged a turning, drove off a hilly road and the vehicle landed 40ft below on a dual carriageway. Mr W suffered moderately severe neck injuries, and upon his return to England was unable to work in his business for a period.
Mr W was initially reluctant to sue his friend for damages and did not consult Irvings for a year after the accident. However Irvings were able to deal with the matter sensitively but firmly. Mr W was fully compensated for his injuries and loss of earnings despite the fact that he had only started his business shortly before the accident and so had no accounts on which to rely. Irvings used a forensic accountant to produce various scenarios of how his business would have progressed had it not been for the accident and this ultimately allowed a substantial settlement to be reached.
Irvings win compensation for man injured while on holiday
Mr S was injured when he was on holiday with his wife in Eastern Europe. He slipped as he stepped out of the shower, which unknown to him had leaked badly onto the bathroom floor, and he suffered injuries including a fractured arm.Mr S had travelled on a package holiday which was purchased from a leading travel company. As is often the case, the holiday insurance he had purchased did not cover a claim against the tour operator.
Despite the accident happening overseas, Irvings advised that we were able to pursue a case for Mr S against the holiday company under the Package Tour Regulations. We arranged a medical and x-ray to show the extent of the injuries and made a claim. The holiday company denied liability completely, saying that there had been nothing wrong with the shower, so we issued court proceedings.
The case concluded when the holiday company agreed to settle about a week before the case was due to go to court and they paid substantial compensation to Mr S for his injuries and for his ruined holiday.
