West Yorkshire Police Unlawfully Detain Innocent Man for Eight Minutes

Background

Mr Matthew McConville, Head of Irvings Law’s specialist Actions Against the Police, has successfully represented a client in a claim for compensation against West Yorkshire Police. Due to confidentiality, the client will be referred to as Mr C.

In the early hours, Police Officers from West Yorkshire Police entered into Mr C’s home whilst he was in bed and immediately arrested him on suspicion of criminal damage before he was then handcuffed and permitted to get dressed. After this, Mr C was escorted into a Police vehicle with a view to being transported to a local Police Station but on the way to the same, it became apparent that West Yorkshire Police arrested the wrong person and so Mr C was driven back home and de-arrested.

Representation

After this, Mr C approached specialist Actions Against the Police Solicitors, Irvings Law, for assistance. Mr McConville immediately acknowledged that what happened was completely wrong and without hesitation, offered to act for Mr C by way of “no win, no fee” presenting a claim to West Yorkshire Police on the basis of breach of Mr C’s human rights, false imprisonment and also assault/battery.

Resolution

Upon receipt of Mr C’s claim, West Yorkshire Police admitted liability entering into settlement negotiations right away. The same resulted in Mr C settling his claim on a full and final basis for a sum just shy of £6,000.00 including the payment of his legal costs.
