Switching Solicitors Leads to Better Results

Jan was a forklift truck driver who was working at a warehouse when unfortunately, one of his colleagues drove another forklift truck into him whilst he was un-stacking pallets and his shoulder was crushed.

Jan initially went to another firm of solicitors who sent the claim to his employer.  They admitted fault for their employees actions but they also said that Jan should be partially at fault; stating if he had parked his forklift properly, then his forklift would have prevented him from getting such a serious injury.  Jan’s previous solicitors dragged things out for around two years and when not much was done, he got fed up with the way that his previous solicitors handled his case and came to Irvings.

We investigated his employer’s claim alleging Jan’s fault and were confident his actions did not cause his injuries. We then arranged for Jan to be seen by a medical expert so that a report could be obtained on his injuries.  Following this, we issued proceedings in order to progress matters.  His employer continued to say that Jan should be held partially responsible for the accident, but we stood our ground.

Following negotiations, Jan’s case was settled for £17,500.00 shortly before trial.
