Cheshire Constabulary Disclose Address of Victim to his Assailant in Bail Conditions

Background

Mr Matthew McConville, Head of Irvings Law’s specialist Actions Against the Police and Data Breach Department, has successfully represented Aaron Kelly in a claim for compensation against Cheshire Constabulary.

Mr Kelly and his family were being threatened by a violent individual. Given the nature of this violence and the treats, Mr Kelly reported this individual to Cheshire Constabulary. The individual was then arrested and later released on bail but within such conditions, the address of Mr Kelly and his family was disclosed without consent to the individual when he didn’t know the same beforehand. Upon becoming aware of the same, Mr Kelly complained to Cheshire Constabulary and in response, they apologised for the error that had occurred and assisted in a property move thereafter.

Representation

After this, Mr Kelly approached specialist Actions Against the Police & Data Breach Solicitors, Irvings Law, for assistance. Mr McConville immediately acknowledged that what happened was completely wrong and without hesitation, offered to act for Mr Kelly by way of “no win, no fee” presenting a claim to Cheshire Constabulary on the basis that Mr Kelly’s human rights to privacy were breached as well as GDPR following this misuse of private information.

Resolution

After presenting the claim, Cheshire Constabulary wished to settle Mr Kelly’s claim and an agreement was reached not long after such discussions took place in the sum of £5,400.00 including the payment of his legal costs.
