Cheshire West & Chester Council Share Address in Error

Background

Mr Matthew McConville, Head of Irvings Law’s specialist Data Breach Department, has successfully represented a couple in their claim for compensation against Cheshire West & Chester Council. Due to confidentiality, the clients will be referred to as Mr & Mrs P.

There was a Family Court hearing involving Mr & Mrs P and Mrs P’s ex. Shortly before the same, Mrs P was supplied with a report prepared by Cheshire West & Chester Council which stated Mr & Mrs P’s personal details in unredacted form and it was confirmed to Mrs P that this report had also been shared with her ex-partner a few days prior whom did not know where Mr & Mrs P lived. Mrs P’s ex-partner was previously abusive towards her as evidenced by his past convictions and imposed Non-Molestation Orders. For obvious reasons, Mr & Mrs P immediately feared for their safety and without hesitation lodged a complaint to Cheshire West & Chester Council. In response, an apology was provided and Cheshire Constabulary had been contacted so as to secure additional protection on their address.

Representation

Given the above, Mr and Mrs P approached specialist Data Breach Solicitors, Irvings Law, for assistance. Mr McConville immediately acknowledged that what happened was completely wrong and without hesitation, offered to act for Mr & Mrs P by way of “no win, no fee” presenting a claim to Cheshire West & Chester Council on the basis their human rights to privacy were breached as well as GDPR following this misuse of private information.

Resolution

After presenting the claim, Cheshire West & Chester Council wished to settle Mr & Mrs P’s claim and an agreement was reached not long after such discussions took place in the sum of £5,500.00 plus the payment of their legal costs.
