Clarion settle before trial after tenant suffers years of disrepair

Background

Ms. D moved into the property in 2016, and her problems began in December 2018, a leaking radiator and damp in the living room, defective radiators in the kitchen and bathroom, damp in the bedroom and a lack of hot water.

Ms. D complained to Clarion Housing Association straightaway, however, after several years of no improvement and having to resort to using Calor gas camping fires and blow heaters to heat her home, Ms. D instructed us to commence a housing disrepair claim.

Representation

Clarion was put on notice of the matter in June 2022, and a surveyor attended and valued the disrepair to be over £5,000.00. However, the landlord disputed liability, and so, legal proceedings were issued a few months later.

Resolution

After an exchange of offers to settle the matter, and less than two weeks until the trial, Clarion, agreed to pay Ms. D £2,750.00 in compensation and for the works to be completed within 120 days.

We hope that Ms. D is satisfied with the repairs to her property and is able to enjoy the same, once more.
