Elderly Care Home Resident Seriously Injured After Being Left Unattended on Stairs

Background

We acted for an elderly lady, a protected party, who sustained serious injuries whilst a resident in a Care Home; owned and operated by the Defendant. The claim was pursued on her behalf by her daughter and Litigation Friend.

The Claimant fell down a flight of stairs within the care home. At the time of the incident, the Claimant was under the supervision of a night agency carer. The carer left the Claimant unattended on the stairs, resulting in her falling and sustaining significant injuries.

Following the fall, the Claimant was taken to a nearby Hospital, where she remained for treatment for approximately six months. She was subsequently discharged to a different care facility.

As a result of the incident, the Claimant sustained a serious head injury, lacerations, displaced fractures to the vertebrae, a fracture to her right leg, and various soft tissue, contusion and abrasion injuries.

Representation

Irvings were instructed to act on behalf of the Claimant, a protected party, through her Litigation Friend. A claim was brought against the Defendant care home for damages arising from personal injury, on the basis that the Defendant failed to ensure the Claimant was adequately supervised and kept safe whilst moving within the care home, particularly during the night-time period.

The Defendant ultimately agreed to resolve the claim by way of settlement.

Resolution

The claim settled by agreement, with the Defendant agreeing to pay the Claimant the sum of £50,000. The settlement was reached by consent and approved by the court given the Claimant’s protected status.

This case highlights the critical importance of appropriate supervision, particularly for vulnerable elderly residents, and the need for care homes to ensure that agency staff adhere strictly to safeguarding procedures to prevent avoidable harm.
