Elderly Gentleman Robert Repeatedly Assaulted by Residents at Care Home

Background

Irvings Law acted for the family of an elderly man who suffered neglect due to the sub-standard care during a short period in a care home. Our client was assaulted on numerous occasions by other residents at the care facility.  The home did not act to prevent such repeated occurrences after the first assault and the attacks increased to the extent that the final one led to the hospitalization of our client.   The assaults  resulted in numerous soft tissue injuries to his body and face over a period of time which caused him pain, suffering and distress.  His family also suffered when he suffered. They tried to advocate with the home on his behalf without fail during this period of time.  Upon discharge from hospital he was admitted to a new care facility. 

We felt the care home failed to ensure his safety, to move him after he was first assaulted or put any procedures in place after the initial assault; failed to ensure sensor mats working or put a gate on his room which was a target for other residents; failed to have any proper risk assessment or care plan in place to prevent further attacks and overall they failed at managerial level to investigate these attacks and stop them.

Representation

Irvings Law worked with the family in order to raise a letter of claim against the care home.  We recovered damages for the estate of our client

It was very clear from the outset that our client was let down by the nursing home who failed in terms of the allegations noted above in particular in relation to the urgent basic need to keep our client safe whilst in their care.

As we know injuries to the elderly tend to have a disproportionate affect. Even minor injuries in an elder person can tend to wreck people’s lives.

Resolution

The injuries and distress suffered by our client would  have been completely avoided if the nursing home had acted immediately to keep him safe. He would not have had to endure repeated assaults and injuries. This would have substantially improved his quality of life in the care home.  

This case highlights the failings of the nursing home to meet the standards that they ought to when providing care.
