Elderly lady suffers an abrupt end to her life due to care home failings

Background

Elderly lady Margaret fell down flight of stairs suffering an abrupt and violent end to her life due to care home failings.  

Irvings Law acted for the family of an elderly lady who suffered neglect due to the sub-standard care during a short period in a care home. Our client was offered a room on the ground floor which was unacceptable due to the very poor condition of it (poorly lit, filthy with trailing wires – her family objected).   She was subsequently moved to a room on the second floor which was near a flight of stairs. Our client had Alzheimer’s, visual impairments and a condition which led her to hallucinate, all of which was known to the home when she was admitted.   The care home apparently risk assessed this room and deemed it safe for our client. Unfortunately our client exited her room and fell down the nearby stairs suffering catastrophic injuries from which she was unable to recover from. She passed away within a very short space of time.

The home failed to properly assess her mobility, physical strength, walking ability; failed in updating their assessments; removing a sensor mat and not replacing with an alternative warning system; failing to have a best interest meeting or seek specialised advice; wrongly calculating their own risk assessments, and failing to follow their own professional judgment about where they placed her.

Irvings Law worked with the family in order to raise a letter of claim against the care home.  We recovered damages for the estate of our client

It was very clear from the outset that our client was let down by the nursing home who failed in terms of the allegations noted above in particular in relation to the urgent basic need to keep our client safe whilst in their care.  

As we know injuries to the elderly tend to have a disproportionate affect. In this case our client lost her life which led to extreme distress for her family.

Resolution

The initial  injuries and distress suffered by our client would  have been completely avoided if the nursing home had acted immediately to keep her safe. Her family suffered the loss of their loved one due to these failures.

This case highlights the failings of the nursing home to meet the standards that they ought to when providing care.
