After a fall, he complained of significant pain but was not referred for urgent medical assessment for several days. When he was eventually admitted to hospital, he was diagnosed with a fractured hip and required surgery. His condition deteriorated thereafter, and he sadly passed away.
A safeguarding investigation substantiated neglect and acts of omission, including delayed medical attention, inadequate monitoring, and failures in record-keeping and risk management.
Irvings pursued a negligence claim against the care home, arguing that it failed to adequately assess and manage the resident’s high risk of falls, update care plans in response to deteriorating mobility, seek timely medical treatment following a serious fall, and properly document and communicate incidents. It was contended that these failures caused unnecessary pain, loss of mobility, and contributed to his decline and death.
On behalf of the estate, Irvings Law successfully negotiated a settlement of £17,000 in damages, reflecting the pain and suffering endured by the resident and the care home’s admitted failures.
