Ladder Fall Leads to Employment Dilemma

Jim had an accident at work back in early 2016. He was on a ladder working when a forklift truck driver drove into the ladder and the ladder began to fall. Jim had just seconds to take evasive action and jump to safety and in doing this he injured himself. Soon after he had the accident he got in contact with Irvings Law to see if he could make a claim.

When Jim initially contacted us he understandably had concerns about the impact making a claim might have on his employment. Jim’s dilemma was that he wanted to be fit and able to work, but didn’t want to cause problems for his employer. We explained to him that employers carry insurance to protect themselves in these situations, and that it would be his employer’s insurers who would deal with the claim and provide compensation if it was successful. Upon understanding the process, he instructed us to move forward with his claim.

Due to the accident, Jim had sustained various injuries. He suffered an injury to his ankles and arm. We took steps to get Jim medically examined by an orthopaedic surgeon. Physiotherapy was recommended and we were able to arrange this privately for Jim.

Jim was in a lot of pain and discomfort, but the physiotherapy helped him a lot. And with the help of this treatment he made a full recovery from his injuries. Jim also wanted to claim for travel expenses and the time he had off work after the accident. We took steps to add those items to his injury valuation in his claim and we were able to reach a settlement for just over £5000.

Jim was very happy with the settlement and very happy that physiotherapy was arranged so quickly for him. Undoubtedly, this helped with the speed of Jim’s recovery and he was able to get back to work pain-free.
