Housing Association pay out compensation to client plus full costs of repairs

Background

Miss K moved into the property in November 2021 and almost immediately noticed many problems in the property – the main problem being severe damp and mould throughout her home.

Representation

After nearly 18 months of constant complaining, Miss K instructed Irvings Law to pursue a claim on her behalf as a consequence of being continuously ignored by her Landlord. At this point, Miss K was desperate to get all repair works completed to allow her to live comfortably and safely in her home. We also aimed to compensate Miss K for the distress she had experienced whilst living with the disrepair.

We obtained an expert surveyor’s report which confirmed there was in excess of £4,000.00 worth of repairs outstanding. Vivid Housing Association were unresponsive, so court proceedings were subsequently issued.

Resolution

Vivid Housing eventually made an offer of settlement in the sum of £500.00 in addition to repair works to be completed within 90 working days. We didn’t believe this to be an acceptable offer so pushed forward with the case. During negotiations, on behalf of Miss K we put forward an offer of £1,500.00 compensation, plus all £4,000+ worth of repair works to be completed within 56 days – which was accepted by Vivid; bringing the claim to a successful conclusion.
