Injured While Abroad – How Irvings Helped Sarah

It’s a time to relax and forget about the day to day responsibilities of life whilst you are on holiday and being injured is the last thing you would want or expect to happen. But if it does, and was caused by someone else’s negligence, you may have a personal injury claim like our client Sarah.

Sarah was enjoying her holiday in Spain during September 2015 when she slipped in a pool of water on the floor of the hotel restaurant.  It could happen to anyone, but unfortunately Sarah sustained neck, hip, leg, ankle and back injuries that required hospital treatment.

We were contacted by Sarah upon her return to the UK to put forward a personal injury claim against the tour operator TUI (Thompson Holidays). They disputed liability for the accident, saying it was not their fault. They relied on what they thought was an acceptable system of cleaning and maintenance that was in operation by the Spanish hotel.

It was then up to us to obtain evidence that this was not the case; this is commonly referred to “local standards” evidence. After doing research and an investigation, we moved forward with the claim and issued proceedings, satisfied with the evidence gathered to support our view that the hotel’s system was unsatisfactory. Even after we issued proceedings, TUI’s lawyers did not admit liability.

Shortly before trial however, TUI made an offer to settle the case, which Sarah accepted. She received a sum of £4000 for her pain and suffering and to help her recover from her injuries.
