Injured in the Cycle Lane

Cycling is a popular activity done for sport, commuting and health. With it becoming more popular, the likeliness of being involved in an accident increases and can even occur when a car isn’t moving.

Liam was on his way home from work, cycling in the cycle lane when the defendant opened his car door, hitting Liam. He sustained a laceration to his shoulder as a result and was left with a permanent, prominent scar. He took the initiative to take photographs of his injuries, which were time and date stamped, that later proved very helpful to his claim.

It was almost two years post-accident when Liam contacted Irvings, but he was still within the three year limitation period so we were able to pursue his claim.

The defendants admitted the accident occurred but alleged that Liam was not injured and they cited his time delay in bringing the claim as an issue. This was of course not an issue as Liam had brought his case to us in time. We moved forward with his claim and the matter went all the way to trial.

After hearing Liam’s evidence regarding the accident and injuries sustained, the judge found him to be an honest and reliable witness. Liam was awarded £8000 in full and final settlement. The Judge also criticised the defendants for their conduct as they had taken the case all the way to trial even though there was clear photographic evidence that Liam had sustained an injury as a result of incident. Liam was satisfied with the outcome of his claim.

Personal injury limitation is three years post the date of the accident for adults and three years from the 18th birthday of a minor. Within those times you can contact Irvings and we will be happy to discuss your claim in more detail.
