Irvings Law have successfully represented a Client in a data breach compensation claim against a mortgage administration company; the parties agreed to keep settlement details confidential so for the purposes of this case report they will not be named.
The said company sent a letter incorrectly addressed to the Claimant. The personal data of the Claimant that was compromised included their full name address, account number with the company, details of their ongoing PPI complaint, previous PPI claims and much more. The Claimant made a complaint to the company about what they had done and they in turn, accepted the facts surrounding the breach. As the Claimant was not happy with this mere acceptance, she sought further legal advice so as to obtain compensation.
The Claimant instructed specialist data breach law firm, Irvings Law and specifically, Miss Yvonne Dobson; a Solicitor in their said Data Breach Department. Miss Dobson offered no win, no fee terms to the Claimant without hesitation and after this, was instructed to lodge a Letter of Claim to the defaulting company. Miss Dobson alleged that the Claimant was entitled to compensation for breaches of the Data Protection 2018, General Data Protection Regulations (GDPR), Confidence, Misuse of Private Information also loss of control/invasion of privacy.
In response, the defaulting company denied liability to the Claimant and Miss Dobson’s surprise. Miss Dobson advised the Claimant that there was no other option but to then proceed to Court litigation. Once this intention was disclosed to the defaulting company, various negotiations then followed between the parties whereupon an agreement was eventually reached them for a significant amount of compensation and legal costs.
