Liverpool City Council Pay £36,500.00 for Breaching Foster Family’s Address

Background

Mr Matthew McConville, Head of Irvings Law’s specialist Data Breach Department, has successfully represented family in their claim for compensation against Liverpool City Council. Due to confidentiality, the said family will be anonymised.

Liverpool City Council disclosed the home address of a foster family to the biological father of their foster child in error when sending unredacted documents to all parties within ongoing Court proceedings.

After this, the involved family approached specialist Data Breach Solicitors, Irvings Law, for assistance. Mr McConville immediately acknowledged that what happened was completely wrong and without hesitation, offered to act for the involved family by way of “no win, no fee” presenting a claim to Liverpool City Council on the basis that their human rights to privacy were breached as well as GDPR and their confidence following this misuse of private information.

Resolution

Strangely, Liverpool City Council did not respond to the involved family’s claim so Mr McConville advised to commence Court proceedings which they followed. After doing this, Liverpool City Council admitted to committing the above breaches but disputed the family’s impact despite the same being wholly clear within served psychiatric medical evidence. As the claim progressed, it transpired that Liverpool City Council had breached the home address of the involved family a second time by the same method but this time to the foster child’s biological mother. As such, Mr McConville invited Liverpool City Council to attend a Joint Settlement Meeting which was accepted and of which resulted in the involved family settling their claim in the sum of £36,500.00 including the payment of their legal costs.
