Mr Matthew McConville, Head of Irvings Law’s specialist Data Breach Department, has successfully represented Ms Sarah Humphreys in a claim for compensation against Mersey Care NHS Foundation Trust.
Mersey Care NHS Foundation Trust accessed Ms Humphreys NHS file and shared her NHS number and details with regards to a psychiatric appointment with her former employer without consent. In addition to this, Mersey Care NHS Foundation Trust also erroneously shared Ms Humphreys’ email address with a third party once more without permission. Further to this, Ms Humphreys made a DSAR request for all information held by Mersey Care NHS Foundation Trust which was also not responded to within the requisite time frame as prescribed by data protection legislation.
Due to these issues, Ms Humphreys approached specialist Data Breach Solicitors, Irvings Law, for assistance. Mr McConville immediately acknowledged that what happened was completely wrong and without hesitation, offered to act for Ms Humphreys by way of “no win, no fee” presenting a claim to Mersey Care NHS Foundation Trust on the basis her human rights to privacy had been repeatedly breached as well as GDPR following the above misuse of private information and acting in accordance with legislation.
After presenting the claim, Mersey Care NHS Foundation Trust refused to settle Ms Humphrey’s claim leaving her with no other option but to issue and serve proceedings. After involving the Court however, Mersey Care NHS Foundation Trust then wished to settle Ms Humphrey’s claim and an agreement was reached not long after such discussions took place in a sum in excess of £12,000.00 including the payment of her legal costs.
