Midland Heart finally compensate tenant after numerous low offers

Background

At the time of instruction, the Claimant had been suffering from disrepair and defects to the property since 2019. Regular complaints were made to the Landlord, Midland Heart Limited however, they failed to undertake remedial works to resolve the disrepair. The disrepair included damp and mould throughout the property, as well as a leak coming through the bathroom wall.

Representation

A surveyor was instructed to attend, inspect and report upon the disrepair to the property. The surveyor confirmed that there was damp and mould throughout the property – as well as a persistent leak, and a total repair cost of over £2,000.

Resolution

The defendant made a very low offer of £150 which was greatly disproportionate to the housing disrepair. We instead made an offer of £3,000 which was not accepted, so they offered a further low offer of £450. Due to the significant differences court proceedings were issued.

In response, the defendants made multiple offers, and the case finally settled for a total of £4,500 with all works to be completed within the next 8 weeks.
