North Yorkshire Fire and Rescue Service Disclose Employee’s Records In Error

Irvings Law has successfully represented a client in a data breach compensation claim against North Yorkshire Fire & Rescue Service. They will be referred to as the “Mr X” for the purposes of this case report and North Yorkshire Fire and Rescue Service will be abbreviated to “NYFS”.

Mr X had two jobs and one was with NYFS. NYFS decided to disclose to Mr X’s other employer information and statistics pertaining to his attendance and dates and times of incidents he responded to without his knowledge or consent.

Representation

Due to this, Mr X sought advice from Irvings Law who without hesitation offered to act for them on a no win no fee basis. When instructed, Irvings Law submitted a complaint to the NYFS alleging that they had not kept Mr X’s information safe and secure. In their response, NYFS accepted that this should not have happened and confirmed it would not happen again.

Following this a formal Letter of Claim was sent by us that set out how NYFS had breached / invaded Mr X’s privacy under the Human Rights Act, had breached the Data Protection Act 2018/the General Data Protection Regulation (GDPR) as well as confidence following their misuse of private information pertaining to Mr X.

Resolution

NYFS confirmed that appropriate action had been taken to prevent reoccurrence of the incident and following negotiations a settlement, a significant amount of compensation and legal costs was agreed not so long after.
