Northamptonshire Police Arrest Man Because He Has The Same Name As The Perpetrator

Background

Mr Matthew McConville, Head of Irvings Law’s specialist Actions Against the Police Department, has successfully represented Luke Jones in a claim for compensation against Northamptonshire Police.

Northamptonshire Police received a grievous bodily harm report naming the perpetrator as a ‘Luke Jones’. A couple of weeks later, Police Officers from Northamptonshire Police arrived at Luke’s place of work and asked if he was ‘Luke Jones’ Perplexed, Luke confirmed that he was and without any further questioning, the attending Police Officers proceeded to arrest Luke on suspicion of committing the above grievous bodily harm. Luke was then patted down and taken to the Police Station before being booked in. Once he was able to speak to his solicitor, Luke was told that he was not the ‘Luke Jones’ Northamptonshire Police were looking for and so he was subsequently released.

Representation

After his release, Luke approached specialist Actions Against the Police Solicitors, Irvings Law, for assistance. Mr McConville immediately acknowledged that what happened to Luke was completely wrong and without hesitation, offered to act for him by way of “no win, no fee”. After obtaining all documentation, information and footage from Northamptonshire Police, Mr McConville alleged that Luke’s arrest was completely unlawful as there was no reasonable suspicion of him being linked to the report of this crime other than his name and if asked, Luke would have assisted with any enquiries that Northamptonshire had of the matter.

Resolution

After lodging his claim, Northamptonshire Police admitted that Luke’s arrest was unlawful and so negotiations ensued. Northamptonshire Police agreed to pay Luke £2,500.00 plus the payment of his legal costs.
