For Ms. S the problems with her property began in December 2020, as a hole in her ceiling caused a water leak – which then resulted in uncontrollable mould growth in her bedroom. This disrepair was impacting her son’s respiratory health, as he has been hospitalised twice, and sadly subsequently developed pneumonia.
Ms. S began complaining to her landlord (Paragon Asra Housing Limited – or ‘PA Housing’) straight away, but the only action that was taken was numerous inspections which did not result in any of the recommended works being completed.
PA Housing was put on notice of the matter in April 2023, following a letter of claim being sent. Subsequently, a surveyor attended Ms. S’s property and valued the disrepair to be over £1,200.00. Despite her landlord having sight of the surveyor’s report detailing the disrepair in Ms. S’s home, liability was disputed and legal proceedings were issued.
Due to the non-compliance of Paragon Asra Housing Limited, judgment was entered and listed for a hearing in February 2024. The day before the hearing, PA Housing sought to settle the matter, and after negotiations, agreed to pay Ms. S £4,000.00 in compensation and for the works to be carried out within 56 days.
