Previously, Ms. M had dealt with another firm of solicitors back in July 2019 regarding ongoing leaks and patchwork repairs, after moving into the property in 2014 and complaints being made since 2015. Ms. M’s first disrepair claim was concluded with the works being completed in February 2020.
Less than a year later, Ms. M found herself in the same predicament, another leak, along with damp and mould. Despite ongoing complaints to her landlord, Peabody Trust, an acceptable resolution was not reached, and Ms. M instructed ourselves for a second housing disrepair claim in April 2023.
A letter of claim was sent in July 2023 and a surveyor was instructed to attend Ms. M’s property in September 2023 and found disrepair with a value of over £6000.00.
Peabody Trust did not respond to the Letter of Claim to admit or deny their liability; therefore, proceedings were issued in February 2024. Peabody Trust failed to comply with the Court’s directions and judgment was obtained in default. The matter was listed for a disposal hearing in May 2024 to determine the level of compensation to be awarded to Ms. M.
Later than the deadline of the Court directions, Peabody Trust filed a Defence to the claim denying liability. However, their position changed ahead of the disposal hearing, as offers to settle the claim were put forward but they did not fully consider the length of time Ms. M had to endure the disrepair in the property and the amount of damage caused.
At the hearing, the Judge ordered that Peabody Trust pay Ms. M £7000.00 in damages, along with the works recommended by the surveyor, by July 2024.
We hope that all the works in Ms. M’s property has been completed to the standard of the surveyor, and Ms. M can move on from the distress and inconvenience of the last few years and begin to enjoy her property once more.
