Mr M had been complaining of a leak coming through the kitchen ceiling and cracks in the hallway, living room, kitchen and bathroom since November 2020 -as well as Damp and Mould throughout the property from September 2022.
Despite his reports of the disrepair, Peabody Trust and its contractors failed to rectify the issues, completing only patchwork repairs that ultimately failed to resolve the issues in Mr M’s home.
After years of complaining and getting nowhere Mr M instructed us to act on his behalf. A surveyor was instructed and attended Mr M’s property and found disrepair with a value of over £4,500.
Despite this, Peabody Trust denied liability and the claim was issued at Court. Judgment was obtained and the claim was listed for a Disposal Hearing to determine the level of compensation to be awarded to Mr M.
In order to avoid paying further legal costs, Peabody agreed to Pay Mr M £4,000.00 for the distress, inconvenience and embarrassment he had suffered due to their failure to keep the property in good condition. They also agreed to complete all repair works as per the surveyor’s report and pay Mr M’s legal costs.
We trust all works will now be completed to the satisfactory standard outlined in the settlement agreement; to allow Mr M to feel comfortable in his home once more.
