Mr Matthew McConville, the Head of our specialised Data Breach Department at Irvings Law has successfully represented a client called Samuel Courtnell in a data breach compensation claim against Reed Autos.
Mr Courtnell received a phone call from A-Plan Insurance regarding a vehicle that he was interested in purchasing from Reed Autos although he did not consent to them providing his name and contact information. Unhappy with this, Mr Courtnell sought specialist recourse from data protection firm; Irvings Law.
Without hesitation, Mr McConville offered to act for Mr Courtnell on a no win, no fee basis and once instructed, Mr McConville lodged a complaint to Reed Autos and the ICO as clearly, they had disclosed Mr Courtnell information without the appropriate consent being obtained beforehand.
Unfortunately, Reed Autos did not accept that they were in the wrong but the ICO sided with Mr McConville and as such, he lodged a Letter of Claim on behalf Mr Courtnell given that they had breached / invaded his privacy under the Human Rights Act, had breached the Data Protection Act 2018/the General Data Protection Regulation (GDPR) as well as confidence following their misuse of private information pertaining to Mr Courtnell.
Upon receipt of this, thankfully Reed Autos changed their mind and wished to engage in settlement discussions. After tough negotiation from Mr McConville on behalf of Mr Courtnell, settlement of £2,500.00 was reached without Court proceedings needing to be issued or served.
