Irvings Law successfully represented a roofer who was working at height on a roof under the supervision of a senior roofer. The roofer dropped a mastic gun from the ridge of the roof down into the adjacent garden. Access could not be gained to the garden as the garden gate was locked and therefore, the young roofer climbed down off the roof via the front access ladders and proceeded to climb over the adjacent wall to the garden. On his way back over the wall the concrete lintel and surrounding bricks gave way, and the Claimant fell into the adjacent alley way. The concrete lintel and bricks landed on the young roofer’s ankle and he sustained serious ankle fractures. The roofer had not been given any lanyard or rear access ladders which would have enabled him to climb down into the rear garden safely.
A formal Letter of Claim was sent to the roofer’s employer placing them on notice that they were held accountable for the roofer’s injuries because of their failure to provide adequate training, supervision and a safe means of access to and from the roof. Liability was formally denied, and the roofer’s employer sought to defend the case on the basis that the Claimant was the author of his own misfortune.
Irvings Law obtained medical evidence from expert witnesses in the fields of Orthopaedics, Pain Management and Psychiatry. The parties’ expert witnesses prepared joint statements and the Defendant continued to maintain a denial of liability until settlement was achieved in the sum of £65,000 plus legal costs. The Claimant recovered damages for pain, suffering, loss of amenity, loss of earnings, rehabilitation costs and miscellaneous expenses.
The roofer made a good recovery, returned to education to obtain a degree with which to enhance his Curriculum Vitae.
