South Gloucestershire Council Unlawfully Disclose Family’s Personal Details

Discovery

Irvings Law has successfully represented a Claimant in an action against South Gloucestershire Council for their breach of the Data Protection Act 2018/General Data Protection Regulations 2018, Article 8 of the Human Rights Act 1998, Confidence and a Misuse of Private Information.

On the 20 December 2019, in an email, South Gloucestershire Council confirmed to the Claimant that they had sent a letter enclosing his and his son’s address to his ex-partner.  This caused a great deal of distress and left the Claimant understandably feeling anxious and fearful.

Representation

Unhappy with this, the Claimant then instructed the specialist team at Irvings Law to represent him and his son in their data breach claims against South Gloucestershire Council and a Letter of Claim was duly submitted to them for consideration.

Resolution

South Gloucestershire Council responded by admitting they had committed a breach and confirmed that they had implemented data protection practices to avoid further breaches. Following negotiations, the Claimant and his son’s claims settled for £4,000.00 and £2,500.00 plus legal costs and the latter subject to the Court’s approval.
