Unemployed Passenger Recovers £110,000 Damages For Pelvic Fracture

Background

Irvings Law represented a Claimant who was a rear seat passenger in a motor vehicle that was involved in a high speed crash when the driver of the vehicle lost control of the vehicle and collided with several stationary vehicles and demolished a wall.

As a consequence of the accident the Claimant sustained a fractured pelvis requiring open reduction and internal fixation together with a right shoulder fracture and a fracture to his back.

Representation

The claim was originally dealt with the by Motor insurer’s Bureau as it was believed that the driver was uninsured.  Prometheus Insurance Company Limited then took over the defence of the claim when the existence of a trade policy of insurance was produced.

Court proceedings were issued and whilst primary liability was accepted, contributory negligence was alleged on the basis that the Claimant:-

1. Was not wearing a seatbelt; and
2. Allowed himself to be driven by the driver of the vehicle when he knew or ought to have known that the driver had consumed excess alcohol and/or had consumed elicit substances such that the driver’s ability to drive safely was impaired.

In order to investigate the allegations of negligence made, expert witness evidence was obtained from experts in the fields of:-

1. Accident & Emergency Medicine
2. Toxicology
3. Accident reconstruction

Resolution

A settlement was negotiated in the sum of £110,000.00. The Claimant recovered damages for pain, suffering, loss of amenity, rehabilitation costs, some past loss of earnings and miscellaneous expenses. The Claimant did make a good recovery and was able to return to work.
