Utility Company agent accesses client’s information without consent

Discovery

Irvings Law have successfully represented a client in a data breach compensation claim against a Utility Company but the parties have agreed to keep settlement details confidential. As such, for the purposes of this case report, the client will be referred to as KC, the Utility Company will not be named.

KC recently moved into their current property, the previous owners used the Utility Company and for ease KC decided to keep their utility services with the same company. An employee of the utility company then gained access to KC’s personal information and attempted to contact KC at their home address and place of work.

Representation

Given these actions of the Utility Company employee and KC’s fear the said employee would continue to try make contact, KC, instructed Irvings Law, specialist data protection firm, to assist in pursuing a claim. KC was offered a no win, no fee terms and a Letter of Claim was duly submitted to the Utility Company seeking compensation following this breach of the Data Protection Act 2018, General Data Protection Regulations (GDPR), confidence and misuse of private information.

Resolution

In response, the Utility Company denied liability but indicated that they were willing to negotiate an out-of-Court settlement with KC and Irvings Law. As such, negotiations then followed which resulted in KC settling the matter for just under £5,000.00.
