The Claimant, Miss R had previously issued a claim against Walsall Housing Group due to disrepairs such as condensation and damp throughout the household. However, another claim had to be put forward because of Walsall Housing Group breaching the original settlement. Despite the Defendant been given over 50 days to complete the reinstatement works, there was a failure to complete this alongside the failure to pay the damages and costs to the Claimant.
The continuous failure from Walsall Housing Group to comply with the terms of the order has caused our claimant unnecessary stress.
Therefore, we acted on her behalf in order to contact the Court and lift the stay currently in place in relation to the carrying out of repairs to her property in addition to further compensation being awarded to the Claimant.
As a result of the further action taken, the enforcement claim was settled for an extra £450 worth of compensation damages. This being in addition to the original claim which totalled slightly over £8,000 in costs and damages. If the new terms aren’t followed by the Defendant, further enforcement proceedings may be brought.
