Wigan Council Breach School Ex-Employee’s Data

Discovery

Irvings Law has successfully represented a Claimant in an action against Wigan Council for their breach of the Data Protection Act 2018/General Data Protection Regulations 2018, Article 8 of the Human Rights Act 1998, Confidence and a Misuse of Private Information.

The Claimant was previously employed by a Primary School and received a telephone call from the School advising that her name, address and telephone number had been disclosed to another pupil’s parent. Wigan Council control the actions of this said School.

Representation

Following the breach of trust, the Claimant felt highly disappointed and contacted Irvings Law for expert advice and instruction were accepted without hesitation on “no win no fee” terms.

Irvings Law made complaints to both the School, the Council and the Information Commissioners Office (ICO). In their response, the ICO advised it is unlikely that the Council complied with their data protection obligations

Resolution

Wigan Council were then pursued and in response to the Claimant’s claim, they admitted the breach and following negotiations made an offer of £2,500.00 plus reasonable legal costs which was accepted.
