Young lady hit by a drunk driver who mounted the pavement

Background

We acted for a young lady who was a pedestrian, walking along the pavement when a drunk driver mounted the pavement hitting her.

The Defendant driver was convicted of driving without due care and attention, driving without insurance and failing to stop at an accident as he left the scene.

Our client suffered extensive injuries to her hip, leg back, shoulder, multiple bruising, scarring to her face and PTSD.  We had to instruct a wide range of experts.   It was a complicated and protracted litigation due to the nature of the injuries.

Our client was very stoical and continued her working life as best she could as well as managing her family throughout the life of claim.

We instructed a case manager to coordinate rehabilitation and organised a range of therapies for her including physiotherapy, acupuncture, hydrotherapy, counselling and Cognitive behavioral therapy (CBT)

We engaged in  a final Joint Settlement Meeting with the Defendant’s Insurer and we were able to successfully negotiate a very substantial settlement which would secure her future.

Representation

We traced the driver, and we brought a claim against the driver for negligence. Even though the driver had no insurance we brought in the Motor Insurers Bureau who acted in the place of the insurer.

Resolution

We achieved a financial settlement on behalf of our client which included future damages for earnings, care and treatments to assist her for the rest of her life.
