A Blistering MRI

When trying to get an injury diagnosed, the last thing you want is another… Unfortunately for our client John, his routine MRI was a painful experience.

John was in for a MRI, or magnetic resonance imaging scan, to diagnose some pain he was having. During the procedure he started to feel a weird sensation in his ankle but it did not hurt at the time, so he didn’t say anything. When the scan was finished, he was astonished to find a burn mark on his ankle. The burn was sizeable and ended up leaving him with permanent scarring.

John called Irvings and was connected with myself and I started his claim. The NHS denied fault saying that the operator did the procedure correctly, so it was either our clients fault for not saying anything about the weird sensation or the equipment was faulty. We then approached the manufacturer and they said there wasn’t anything wrong with the equipment and it must have been the operator’s error. They also mentioned our client, who didn’t feel a burning sensation or have any cause for alarm, should have used the panic button.

Even though both the NHS and the manufacturer would not admit liability, someone was at fault. We issued proceedings, obtained a medical report on our clients burn along with photographic evidence. The case ended up settling for £2,500 and John was happy with the outcome.
