Care Home Neglect Contributes to Elderly Gentleman’s Deterioration

Background

We acted for a family representing the estate of a deceased lady who suffered neglect in a nursing home.  She was only resident for 5 months before she passed away and during that short time due to neglect she suffered pressure sore injuries to her heel, foot and elsewhere on her body.   This caused her family great distress and Irvings took on the claim in order to consider whether the care home by their employees had breached their duty of care in how they looked after her.

Representation

Irvings upon review decided to pursue a claim against the care home on the basis that we could show that had our client had the appropriate assessments, referrals, repositioning, interventions been made then she would not have developed such pressure sores.  A letter of claim was actioned and a denial of liability received from the Defendant care home.

Resolution

Despite such denials, Irvings were successful in securing a settlement on behalf of our client’s estate. This case highlights the critical importance of upholding high standards of care and the significant consequences when those standards are not met.
