Care Home Neglect Contributes to Elderly Gentleman’s Deterioration

Background

We acted on behalf of the estate of an Elderly Gentleman who experienced neglect at the hands of a care home, when he suffered a noticeable deterioration of his mental and physical health. The neglect involved: a failure to document and monitor fluid intake; to establish both a catheter and a medication care plan, and to accurately undertake skin assessments. As a result, our client suffered a deterioration in general health; weight loss, abdominal pain, erosion, and skin pressure sores.

The injuries and illness our client suffered led to a hospital admission, however, by this stage the damage was done and our client never recovered – sadly passing away in hospital. The care home failed to take action when our client’s health was noticeably deteriorating; this would have been identified had our client’s fluid intake been monitored and documented. Furthermore, the absence of a catheter care plan led to erosion which caused our client significant pain and suffering. In observing our client’s ongoing and persistent suffering, his family also suffered considerable distress and anxiety.

On the instruction of our client’s family, Irvings Law brought a claim for neglect against the care home due to their failure to maintain a good standard of care and the devastating consequences of this.

Resolution

Irvings were able to reach a settlement on behalf of the estate of our client. If the care home had undertaken the appropriate care plans and monitored our client’s medication and fluid intake, the subsequent deterioration of his health and severe injuries could have been avoided.

This sad case highlights the importance of executing and maintaining high standards of care in care homes, and the devastating consequences of failing to do so.
