Care Home’s Failure to Perform CPR Leads to Tragic Death of Elderly Gentleman

Background

We acted for the family of an Elderly Gentleman who received sub-standard care during his short stay at a Care Home.

During this stay, our client lost weight and was found to be not eating or drinking and his health deteriorated over this period of time. He suffered a fall not long after admission to the Care Home, injuring his left wrist and hand. This was one of a number of falls that our client suffered; these falls occurred due to our client trying to get in and out of bed.

The Claimant was found to be unresponsive by Care Home staff.  A significant amount of time passed without CPR being performed, despite no DNR being in place for our client. An ambulance was called and regrettably, our client was pronounced dead by the paramedics on arrival.

Representation

We pursued a claim against the Care Home for negligence on the basis that they failed to monitor our client’s nutrition, hydration and diet. This put our client at an increased risk of falls; despite this, a proper falls risk assessment was not conducted. The Care Home also failed to perform CPR on our client and did not act promptly in contacting the authorities when our client went into Cardiac Arrest. Our client’s family have endured significant pain and suffering as a result.

Resolution

Irvings were able to negotiate a settlement on behalf of the estate of our client. If the Care Home had carried out risk assessments for falls and acted promptly when our client went into cardiac arrest, the falls could have avoided and our client’s life could have been saved.

This case highlights the importance of maintaining high standards in care home settings and the unfortunate consequences of not doing so.
