Elderly Man Suffers Fatal Injuries After Fall Whilst Left Unattended

Background

We acted for a family representing the estate of a deceased gentleman who suffered neglect in a care home. Whilst a resident at the home, our client suffered three separate falls. On one of these occasions, our client suffered a nasty fall in his room at a time when he should have been receiving one to one care. Our client was found lying in his room on his right-hand side in significant pain.  After two separate visits to A&E, A CT scan revealed multiple rib fractures on his right side. Our client sadly passed away shortly after this fall; his death certificate records:

I   (a) Acute Bronchopneumonia

(b) Multiple Right Rib Fractures

II Alzheimer’s Disease, Pulmonary Emphysema and Coronary Artery Atheroma

Representation

Irvings were instructed the family to act on behalf of the estate of the deceased. A claim was pursued against the care home on the basis that, amongst other things, the care home failed to: update and implement a robust and effective falls care plan, whilst failing to ensure the 1:1 care was in place. Irvings prepared a Letter of Claim on behalf of the family. No response was received to our letter of claim; however, a formal denial of liability was eventually received later down the line.

Resolution

Despite the aforementioned non-response and subsequent denial of liability, Irvings were able to negotiate a settlement on behalf of our client’s estate. Our client’s case highlights the importance of implementing care plans on a daily basis to the highest possible standard.
