Irvings Law recently represented an elderly resident left a care home unsupervised and sustained a fractured hip as a result of leaving her care home unaccompanied and falling in the street alone.
On admission to the care home, Marie’s care needs were made known to staff. In particular, Marie’s ongoing memory problems were highlighted, including Marie often became wandersome throughout the night. Marie was at a high risk of falls and therefore a venerable resident who required supervision.
After only a few days into her respite placement at the home, Marie was able to escape from the home through an allegedly locked door. Whilst out of the home, Marie unfortunately sustained an unwitnessed fall, suffering a fractured left hip, which required surgical intervention. The fracture had a significantly negative impact on Marie’s mobility and quality of life.
A safeguarding report into the incident found that the Care Home were negligent in not ensuring that they had adequate staffing levels and sufficient locks in place on the external doors of the home. Unfortunately, the care home failed to ensure that Marie was safe through undertaking regular observations throughout the day, and it was determined that such an incident was entirely preventable.
Irvings Law was able to achieve a good financial settlement on behalf of Marie. Although no amount of monetary recompense can take away an individual’s pain and suffering, the case helped to highlight the failings of the care home’s practices and to help drive an increase in standards for other residents, with the aim of preventing a similar incident occurring in the future.
