Elderly resident sustains multiple rib fractures following care home failings

Background

Irvings Law represented the family of an elderly woman who endured significant pain and suffering after a traumatic fall caused by substandard care in a care home. The care home breached its duty of care by failing to conduct proper risk assessments, neglecting to monitor her physical deterioration, and not updating her care plan accordingly. Additionally, the care home failed to seek medical assistance for two days after the fall, despite her being in significant pain and discomfort.

When she was eventually taken to the hospital, a CT scan revealed 11 fractures across 8 of her ribs. The care home not only failed to prevent the fall but also did not seek urgent medical attention or inform the family of the incident. Sadly, she passed away eight days later. Her injuries contributed to her passing and caused unnecessary pain and suffering in her final days.

Representation

Irvings pursued a negligence claim against the care home, arguing that it failed to prevent a foreseeable fall, monitor and assess the resident’s injuries, and seek timely medical assistance. Given our client’s age and declining mobility, the care home should have recognised her increased risk of falls and taken appropriate steps, such as updating her care plan. After the fall, her significant pain and distress should have prompted immediate medical attention.

Resolution

On behalf of the client’s estate, Irvings successfully negotiated a settlement. Had the care home conducted proper risk assessments and acted promptly, the fall could have been prevented, and her suffering could have been avoided.

This case highlights the importance of robust fall prevention measures, ongoing monitoring of residents’ well-being, and maintaining open communication with families.
