Elderly lady suffers fractured hip due to inadequate professional care provided at home

Background

We acted for Mary, an elderly lady who had 10 years previously suffered with a stroke which resulted in her having left sided weakness, being unable to weight bear and having poor eyesight. Our client required full assistance with all transfers and the aid of a hoist. She needed the assistance of two people with all aspects of her personal care. Sadly, she suffered a home care injury.

Mary was being assisted at home when she was hoisted onto a glide about commode. She was asked to sit forward by a carer without being secured and in doing so slid off the chair, fell to the floor and as a result sustained a fracture to her left hip. It was clear that there was a failure to ensure our client was in a safe environment when her personal care was being provided.

The staff did not follow correct protocols in both being present when she was using the equipment provided. It is clear that the carers did not have adequate training which they were subsequently referred for which resulted in this home care injury.

Ultimately, the staff fell below the standard expected of them when caring for an individual such as Mary.

The resulting fracture of course led to considerable pain and suffering by Mary for which she had to have surgery. It resulted in our client having a reduction in her mobility and a loss of confidence after recovery from her surgery.

As we know with elderly people, any injury combined with pre-existing problems can produce an outcome which is far worse than the individual problems involved.

Representation

We presented a claim against the care home company who provided care. It was clear that the lack of training and substandard provision of care had led to a very significant injury being suffered by our client. It had a significant impact on her life and her family’s life.

Resolution

We achieved a substantial financial settlement on behalf of Mary. The carers present were referred for moving and handling refresher training.  The case highlights that even those employed to provide care at home must still do so to a high standard, failing which the consequences can be very real and significant.
