A Shopping Trip Gone Wrong

Laura was enjoying a day’s shopping in London. When she was leaving a clothing store, she fell down a step that led out of the store suffering bruising and lacerations to her hands, knees and chin.  As the embarrassment of the fall faded Laura realised that she needed medical attention and went to the local hospital.

Recovering from her injuries and worried about permanent scarring, Laura contacted Irvings Law to see if we could help.

We took on Laura’s injury claim but the store she was visiting denied any wrongdoing. She hadn’t reported the fall to them nor were there any CCTV images. However, upon visiting the store we noticed remnants of a black and yellow warning tape on the steps. Clearly they were hazardous, but the warnings were barely visible. Tellingly the store redesigned the exit and fixed the tape very shortly after Laura’s fall. With this evidence and an expert report on the injuries we moved towards trial, but the store had a change of heart and contacted us with an offer of settlement of £3000 which Laura was happy to accept.

No one expects to get hurt on a routine shopping trip, but unfortunately due to the negligence of this store it happened to Laura. Potential hazards should be clearly marked to prevent injury, and if signs or stickers fade they should be promptly replaced.
