We acted for the family of an Elderly Gentleman who suffered neglect due to receiving sub-standard care, namely; failure to monitor his care needs and in particular his nutrition and skin integrity. As a result, our client suffered a severe water infection and numerous pressure ulcers, both of which required admission to hospital.
At hospital, it was discovered he had a number of pressure sores on his foot and sacrum. In particular, one was discovered on his foot that could not be treated as it was to the bone. The severity of the injuries and the consequential impact on our client led to him becoming non-verbal. Our client was subsequently discharged from hospital to another care home. Our client sadly passed away shortly thereafter. The death certificate confirmed that the Urinary Tract Infection and Pressure Ulcers being secondary causative factors which led to our client’s death.
We pursued a claim against the Care Home for negligence on the basis that they failed to monitor and record our client’s care needs in relation to skin integrity and nutrition. They did not make any admissions. Our client endured considerable pain and suffering. His family suffered considerable distress.
We reached an agreed settlement on behalf of the estate of our client. Whilst a financial settlement cannot undo what happened, the case is an important reminder of the importance of maintaining a high standard of care and what can happen when such standards are not upheld.
