“Do I have a claim?” is a question you may be asking yourself. If an accident, or injury you sustained, wasn’t your fault, then you are possibly entitled to some form of compensation. Here are some commonly asked questions that we hear as many people think that pursuing a claim for compensation can seem like a long, complicated and expensive procedure. But it needn’t be as we can help you with how to make a personal injury claim.
How long will my case take?
The length of a case is dependent on a lot of different factors such as if liability is admitted or disputed, how bad your injuries are, if you need to have rehabilitation, etc. Each case is unique; therefore there are no general timelines that can be provided for our cases. However, we ensure you are kept updated during the entire process and will talk you through each step of the case.
How much money will I get?
At Irvings we treat you and your claim individually. How one injury effects another person may be different from how it has affected you. We’ll obtain expert medical evidence to evaluate the severity of your injuries and the appropriate compensation for them. We always strive for the maximum compensation for our clients. In addition to compensation for your injuries, we would investigate and discuss with you claims for out of pocket expenses such as, but not limited to:
- Loss or earnings
- Care and assistance provided by family and friends
- Travel expenses
- Repairs to motor vehicles
- Hire charges for replacement vehicles
- Medical bills
How much will it cost me?
When it comes to our fees, we offer a genuine no-win, no-fee arrangement. That means we only get paid if you get compensation. Se essentially contacting us costs you nothing!
How long do I have to make a claim?
Usually a claim for injury must be brought within three years from the date of the accident. There are some exceptions to this and we can discuss these with you upon contacting us. In cases involving minors (under the age of 18), the three year time limit starts on the date of their 18th birthday.
What does no win, no fee mean?
No win, no fee essentially means that we only get paid when we win your claim. In successful cases there will be a maximum deduction from your compensation of 25% in addition to any legal costs paid by the other side.
What if I have a solicitor but am not satisfied with their representation? Can you take over?
If you are not happy with your current lawyers approach or work, we can offer guidance through the process of changing your solicitor quickly.
Will I have to go to court?
The majority of personal injury cases are settled out of court. If it does, we will ensure you are properly prepared and you be will supported throughout the process.
Do I have to go for a medical examination?
Yes. Getting a medical examination by an appropriate doctor, surgeon or other health professional will provide the information needed to determine what treatment you need, the costs of it and recovery timelines of your injury. This also enables us to evaluate the appropriate compensation for your claim.
