Irvings Law acted for the family of an elderly lady who suffered neglect due to the sub-standard care during a short period in a care home, approximately 8 months. The care home failed to look after our client’s skin integrity. Their negligent and incompetent care led to her suffering from multiple pressure sores which were extremely painful and were not managed correctly either by the home or by the tissue viability nurse called in by the home.
As a result she developed sepsis which led to a rapid deterioration in her health and subsequently led to her passing.
Pressure sores are preventable and in this case we alleged that the home failed to reduce the risk of our client developing those, failed to review her care package and evaluate that it was meeting her needs, failed to check and record her air mattress after each re-positioning, failed to contact the tissue viability nurse in a timely manner and to treat that referral as urgent, they failed to record accurately the nature and number of pressure sores, failed to implement risk reduction strategies to prevent them and failed to evaluate her skin integrity every day.
Irvings Law worked with the family in order to present a letter of claim against the care home and against the trust in relation to the tissue liability nurse involved.
It was very clear from the outset that our client was let down by the nursing home who failed in terms of the allegations noted above.As we know injuries to the elderly tend to have a disproportionate affect. Even minor injuries in an older person can tend to wreck people’s lives.
The development of pressure sores could have been avoided if the nursing home had provided appropriate care and management. They would not have deteriorated; our client may not have developed sepsis and may not have passed away.
This case highlights the failings of the nursing home to meet the standards that they ought to when providing care.
