Elderly man suffers fracture to his right neck of femur at residential home.

Background

We acted for an elderly gentleman who was admitted to a care home from hospital for a short period of rehabilitation.

On the day after he entered he fell onto his right side and as a result sustained a fracture to the right neck of femur. He was taken to the hospital and required surgery before being discharged back to his own home.

When our client was assessed upon entering the care home it was noted that he was at high risk of falling. On the date when he fell he was walking in the corridor unsupervised using a wheeled walking frame when he fell backwards sustaining his injuries. The care plan stated that he ought to have assistance of one carer and a wheeled frame and due to being at high risk of falling required monitoring.

The standard at the home clearly fell below the standard expected and they were negligent and competent in their care for client.

The resulting fracture led to considerable pain and suffering by him for which he had to have surgery this resulted in him having a reduction in his mobility and loss of confidence after recovery from surgery.

As we know with elderly people, any injury combined with pre-existing problems may produce an outcome which is far worse than the individual problems involved.

Representation

We presented a claim against the care home in question alleging that they failed to closely monitor a new resident in accordance with their falls and manual handling system, they failed to complete any accident or incident form, they failed in allowing him to mobilise unassisted and unsupervised, they failed to prepare a care plan to identify how he was to be monitored and supervised.

Resolution

The insures on behalf of the care home admitted liability. We achieved a financial settlement on behalf of the estate of our client who had subsequently died due to an unrelated illness. The case highlights that those employed to provide care must do so at a high standard, failing which the consequences can be very real and significant.
